Scope of support

Expertise aligned with your objective and the stage of the matter.

  1. 01Feasibility assessment
  2. 02Structure, beneficiaries and benefits
  3. 03Statute and documentation
  4. 04Asset contributions and tax analysis
  5. 05Registration support
  6. 06Ongoing legal and tax advice
01

Start with the purpose

A Polish family foundation can support long-term asset management and establish rules for beneficiaries. We first examine family circumstances, ownership and business plans. This structure is not appropriate for every situation.

  • Succession and business continuity
  • Separation of ownership and day-to-day management
  • Consolidation of dispersed assets
  • Clear rules for supporting family members
02

Is it right for your family?

We weigh organisational benefits against costs, obligations and restrictions. We consider income, beneficiaries’ needs, the founder’s desired influence and the funding of benefits. Where another solution better meets your objectives, we explain the alternatives.

03

A statute reflecting real relationships

We design governance rules intended to remain useful through generational change. The statute should answer practical questions, not simply reproduce a legal template.

  • Purpose and beneficiaries
  • Conditions for benefits
  • Governing bodies, powers and decision-making
  • Appointment and removal of managers
  • Amendments and changes in family circumstances
04

Assets and structural preparation

We review shares, real estate, cash and other property rights. We assess which assets to contribute, the sequence of contributions and any preparatory reorganisation. We do not assume that all family assets should be transferred.

05

Beneficiaries and benefits

We help balance the positions of family members involved in the business and those outside it. We discuss when benefits begin, the conditions attached and how arrangements should evolve as family needs change.

06

Tax analysis without blanket promises

We assess contributions, activities, investments, transactions, benefits and possible dissolution. Advice depends on the specific structure and applicable rules. Establishing a foundation does not automatically produce a tax advantage.

07

From design to operation

Our work progresses through assessment, structural design, drafting the statute and supporting documents, establishment and registration support, and implementation of asset governance. Scope, responsibilities and timing are agreed at the outset.

08

Support after registration

We assist with resolutions, benefit records, changes to beneficiaries and the statute, investments and ongoing tax matters. The foundation forms part of a wider succession plan, including successors’ roles and future business management.

Frequently asked questions

Is a family foundation suitable for every business?

No. Assets, owners’ objectives, family needs, costs and obligations must be assessed first. Another solution may be more appropriate.

Must all assets be contributed?

The scope is planned individually. We assess the purpose and consequences of each contribution rather than assuming a transfer of everything.

Do you support existing foundations?

Yes. We advise on ongoing legal and tax matters, documentation, governance changes and planned transactions.

What should I prepare for the first discussion?

An overview of assets and ownership, family objectives and expectations for management and benefits. We will agree the detailed document requirements during the discussion.

This page provides general information. Recommendations require an individual review of the circumstances and applicable rules.

Our approach

One matter. One team accountable for the whole picture.

We combine legal, tax, financial and operational perspectives, so recommendations are practical to implement — not merely correct on paper.
