OECD countries and G20 committed to implementing the Country-by-Country Reporting (CBC) mechanism. The OECD's actions were also supported by the European Union, which resulted in an appropriate EU Council Directive requiring Member States to implement this solution. The list of countries with which Poland has agreements authorising the exchange of reports by country has been updated.
Contracts are necessary for the exchange of reports with non-EU countries. After the changes to Poland, reports submitted in Switzerland and Malaysia will be submitted, among others.
It should be noted that there is no legal basis for exchanging reports with China, Hong Kong, Israel, Qatar, Taiwan and Turkey. Entities that have identified as State reporting in CBC-P one from these countries, they are required to indicate another country or to report to Poland (Article 84 Act dated 9 March 2017 the exchange of tax information with other countries; Journal of Laws of 2017, item 648 as amended).
