After a year of pandemic, the law industry is doing well, and even benefits from the crisis, because it entered the technological revolution strongly. E-courts are becoming more and more efficient, and there are already extensive hearings online, even international.

In Poland, switching to remote mode is not an easy matter for courts, as has recently shown, for example, the issue of the draft amendment of the Code of Civil Procedure, which assumes, among other things, that mail sent from court to attorney will be regarded as being served.

In this issue of RB of the Warehouse we summarize February and write, among other things, about the change of kpc in the described scope. A Good Practice Collection of the Court of Arbitration was created for online hearings at Polish Confederation Lewiatan. According to the Confederate press release, “the main threats (ed.

remote hearings) are: violation of the principle of equality between the parties, lack of direct contact with witnesses or experts and technical problems.

In order for remote hearings to be considered equivalent to those carried out on a fixed basis, it was necessary to find solutions to exclude or substantially reduce the risks identified. The arbitration bodies have recently published recommendations for remote hearings.

These include, in particular, the Seoul Protocol on videoconferencing in international commercial arbitration with 18 March 2020, or the Control List published by the ICC.’ As the set of good practices cited above points out, it is important to prepare a number of elements when organising such a hearing, namely: the online trial programme; the time and way of conducting the merger test; the person first contact, responsible for technical issues; minimum Internet connection speed (currently recommended minimum is download 2 Mb/s and upload 1Mb/s[2]); location of cameras and microphones; preparation of instructions to call "step by step"; list of participants; recording of the hearing; handling of technical problems; physical presence at online hearings of witnesses and experts; presentation of documents to witnesses and experts, with the function of presenting the document displayed on the computer screen.

In this issue we also stopped at a loud media protest. The case that affects every citizen and that can change the face of the advertising industry has been handled at various angles, we focus on the meaning, i.e. taxes and numbers that are all the more important in a pandemic.
