Act dated 1 October 2021 on the amendment of the Personal Income Tax Act, the Corporate Income Tax Act and some other laws are amended, inter alia, Act dated 20 October 1994 special economic zones.
According to the new regulations of the SEZ and PSI (Polish investment zones) will lose their current tax advantages. Exemption from the entire establishment's income will be narrowed down.
Only income generated in connection with the implementation of the new investment can be exempt from tax unless the taxpayer demonstrates a close link between the company's remaining activities and the subsidised investment.
The eligible costs will not include the means of transport purchased, which is consistent with the previous line of the fiscal case-law ordering these costs to be considered ineligible.
The good news is that the catalogue of excluded changes in the support decision and the provisions related to the IP Box tax credit has been clarified and, as amended, taxpayers operating under PSI or SEZs will be able to benefit from the IP Box credit on general terms.
