The bill allowing employers to check which of their employees were vaccinated was one from the solutions the Ministry of Labour Development and Technology worked on. After the resignation of the Deputy Prime Minister, who managed, among other things, the work on this project, he was taken over by the Ministry of Health. The new law is expected to enter in accelerated mode in September.
Study Polish Confederation Lewiatan, rod 80% employers feel that they should have access to vaccination information, which will allow them to plan their work and ensure the safety of staff. The question arises whether this need does not interfere with the right to a health secret, as well as with the RPDO records. It is also questionable that the law is compatible with the constitutional right to health, which cannot become an obligation unless the government introduces a law on compulsory vaccination.
However, the government wants to approach the problem differently. In addition to access to the IT system to show the employer who has been vaccinated, the Act is intended to give the employer the right to place the employee under the obligation to test the unvaccinated worker. Often testing is meant to result in an unvaccinated person bending under pressure and deciding to vaccinate.
