The MF Regulation extends time limits for CIT statements and financial statements

Regulations of the Ministry of Finance concerning the extension of time limits for the settlement of CIT income tax and financial statements were published in the Official Journal due to pandemic obstructions. Regulations have already entered into force, so CIT will be able to be settled by the end of June of this year, and financial statements for the private sector later by a quarter.

The amendments are noted in the Regulations:

on 25 March 2021 on the extension of the deadline for the submission of a statement of the amount of income earned (loss incurred) and the payment of tax due by corporate tax taxable persons (Journal of Laws of 2021, item 571);

on 26 March 2021 amending the Regulation on the determination of other time limits for the performance of records and for the preparation, approval, making available and transmission to the relevant register, body or body of reports or information (Journal of Laws of 2021, item 572).

Under their power:

Extends to day 30 June 2021 for corporate tax taxable persons, the deadline for:

  1. to give a statement of the amount of income earned (loss incurred) in the tax year which ended in the period from 1 December 2020 up to day 28 February 2021,
  2. payment of the tax due as shown in the statement referred to Under point 1, or the difference between the tax due on the income shown in that statement and the sum of the advances due for the period from the beginning of the year referred to under Article 27(1) Act dated 15 February 1992 on corporate income tax (Journal of Laws of 2020, item 1406, as amended[2]) ).

Extends to day 30 June 2021 time limit for taxpayers to comply with the corporate tax obligation in question under Article 7aa(9)(2) Act dated 15 February 1992 on corporation tax, if first the year of taxation of those taxable persons on a flat-rate basis on the incomes of capital companies begins from the date of 1 January 2021 up to day 1 March 2021

Given the difficult and dynamic situation associated with COVID-19, a decision to extend the time limits for drawing up the accounts for:

  • private sector entities and non-profit organisations - o 3 months,
  • public finance sector units - o 1 month.

Both Regulations shall apply from the date of 30 March 2021
