The history of the validity of the trade tax continues in the TEU, where the European Commission is ‘hanging’ an appeal against the judgment ruling on the compatibility of such a tax with EU law. Regardless of this procedure, the tax in Poland has already begun to function, although in the event that the Court considers the merits of the EC’s arguments, taxpayers will be able to seek its reimbursement.

Who Will Pay Trade Tax

Danina won't include online vendors. It will be covered by the largest retailers, achieving a monthly surplus of retail revenues over the amount 17,000,000 PLN. The fee will be paid on declarations PSD-1 and out 0.8% above 17,000,000 PLN, if the revenue in a given month has not exceeded 170,000,000 PLN or 1.4% where the seller exceeds the limit 170,000,000 PLN.

Although sales of electricity, certain fuels and medicines are not included in the fee, petrol and fuel oil fall within its scope, and it should be noted that they are already heavily taxed by the emission, fuel, excise and VAT levy.

The new tax is an increase in fuel prices, but also costs for the entire transport industry, which is already burdened by the pandemic. It is understandable that the government is trying to reduce high-carbonity on this occasion, but there should be tax relief, subsidies and easier market transition towards eco-mobility.
