26-27 May 2023, in the Library of the University of Warsaw, conference room 316 them. Samuel Bogumił Lindy, 2nd Mazowiecka Debate on Taxes and Law Tax law and criminal law - difficult relations in jurisprudence. The debate is organised by the Mazovian branch of the National Tax Advisory Chamber. It's nice to let you know one from the speakers will be patron Andrzej Dmowski, CEO Russell Bedford Poland.
Launched in the previous year, the Tax and Law Debate cycle, this time is to concern the relationship of tax law with criminal law. Each tax advisor must associate the subject with the resolution of the Supreme Administrative Court with 25 May 2022 (And FPS 1/21).
Of course, this resolution will also be an important “hero” of our meeting, but it will only be one with a few issues we'll discuss. First of all, we ask ourselves which proceedings: criminal, or tax, should end as first, is one is dependent on second And maybe this.
second dominate whether to determine the content of the solution including second?
The mutual use of evidence from criminal and tax proceedings is also a subject full of confusion. This is worth discussing not only among tax advisers, but also with lawyers -carrists and prosecutors. The case law of the EU Court and the ECHR cannot be disregarded in these discussions.
The second day of the conference will cover specific topics, such as the principles of criminal liability or the tax consequences of crimes. We will also address (professional, tax) secrets in criminal and tax contexts.
Advocate Andrzej Dmowki will give lectures on "criminal liability for falsification of invoices (SA judgment in Warsaw with 24 February 2022, II AKa 448/21)" and "the difficulty of carrying out other evidence as an argument for dismissal from professional secrecy? (order of SN from 19 May 2020, I KZ 8/20)".
The conference will be held in Warsaw University Library - conference room 316 them.
