Under the anti-crisis shield, micro-entrepreneurs received low-interest loans to the 5,000 PLN expenditure on development expenses. The loan and the interest were decommissioned under certain conditions, inter alia after the request for redemption had been made within a specified period.

Entrepreneurs and experts pointed out that this could be a trap resulting in interest on the loan.

On 22 June 2020, The President of the Republic of Poland signed a bill amending the rules on the cancellation of loans 5,000 PLN of the office of employment (started to apply from 24 June this year), which introduces a waiver of the loan without having to submit the above-mentioned application.

Who can get a loan?

A person with the status of a micro-entrepreneur who conducts business before a loan may apply for a loan 1 April 2020. In addition, the criterion of having the status of a company – one-man business activity or a small company employing to 9 employees. The micro-entrepreneur's business must be self-employed.

When applying for a loan, a person is obliged to answer the question whether he has received any other public aid related to COVID-19. Such support shall not preclude the possibility of applying for a loan of 5,000 PLN. The entity in a statement forming part of the application shall inform that it has not submitted a letter of loan to a District Labour Office other than that indicated in the application and that it has no longer received a loan in connection with the COVID-19.

Loan redemption conditions prior to 24 June this year

Before 24 June 2020, Article 15zzd The anti-crisis shields provided for the following conditions for the redemption of the loan 5,000 PLN.

  • Business activity by 3 months from the date of the loan.
  • Submission of a loan waiver application.

Article 15zzd(7) Anti-crisis shields (as before) 24 June 2020:

,,A loan with interest at the request of a micro-entrepreneur shall be decommissioned, provided that the micro-entrepreneur carries out business for a period of time 3 months from the date of granting the loan. In the request for redemption, the micro-entrepreneur declares that he has been operating for a period of time 3 months from the date of granting the loan.’

The redemption of the micro-loan comes from the machine

The current wording of the Article of the Act abolishes the requirement to apply for a loan waiver 5,000 PLN. There's still one significant change. Repeal Article 15zzd(8) The anti-crisis shield referred to criminal liability for making a false declaration of compliance with the operating condition by 3 months from the date of granting the loan.

Only condition for redemption of the loan 5,000 PLN is now conducting business activity by 3 months from the date of granting the loan. There is no need for additional cancellation applications that will be made from the vending machine.
