The new rules on gambling are aimed at increasing the level of state control over the market, oc hr those of players using online gambling services and increasing control over tax revenues from legal gambling. The amendment extends the catalogue of gambling that can be arranged on the Internet, including numbers games, cash lotteries, card games and random slots. The organisation of mutual betting and promotion lottery will be possible by other entities after obtaining the appropriate authorisation.

In addition, the new rules require the authorities of the National Revenue Administration to have remote access to the data stored by the system archiving the gambling operator, which is related to these games. The system is intended to allow the reading, copying and processing of copied data, including in particular data exchanged between the gambling operator and the gambling participant.

In the case of online gambling, processing and archiving devices and their participants should be installed and stored in the territory of a Member State of the European Union or a Member State of the European Free Trade Association (EFTA) of the parties to the Agreement on the European Economic Area

In addition, regulations on the Register of domains to offer gambling will be implemented against the law. This register will make it possible to block access to illegal websites and make it difficult to make payments to providers of illegal online gambling.

The user who tries to get to the blocked page will be redirected to the Ministry of Finance website with information about the “illegality” of the gambling operator. The project provides for the possibility of blocking access to illegal websites and "obstruction of payments to providers of illegal online gambling".

The head of the MF is also to keep a register of domains used to offer gambling in breach of the Act. Anyone who wants to enter such a domain will be immediately redirected to the MF website and will be informed that it is an illegal domain.

The registration will be subject to opposition and the procedure will be subject to judicial review.

The amendment to this Act also redefines the obligations related to payments made by online gambling operators. To date, traders had to carry out transactions only through a payment account operated by banks, credit institutions or other institutions authorised to hold a payment account.

The new solutions extend this catalogue to include the possibility of carrying out payment transactions through designated payment service providers within the meaning of the Payment Services Act. This means that gambling entities will be able to use electronic money institutions and payment institutions.

The Minister responsible for Public Finances will be able to apply to the General Inspector of Financial Information, the Head of the Internal Security Agency, the Head of the Central Anti-corruption Office or the Chief of Police for information on whether there are legitimate objections to the entities that apply for a licence or permit from the point of view of State security, public order, the security of the State's economic interests, as well as compliance with the rules governing the prevention of money laundering and the financing of terrorism.
