Government accepted on 23 August 2022 draft Act on support for victims in relation to the environmental situation in Oder, hereinafter referred to as ‘project’. The following day, the project was addressed to the Sejm, which will start working on this document today.
The assumptions of the draft law are such that contributors within the meaning of the Act of 13 October 1998 the social security system will be entitled to a one-off cash benefit for a specified month, which is intended to limit certain economic impacts related to the ecological situation in Oder. The persons entitled to the benefit shall be:
ed daily 1 July 2022 as the prevailing economic activity as defined in the Regulation of the Council of Ministers; 2) by date 31 July 2022 were reported as a contributor on the date of the obligation to pay contributions no later than 1 July 2022; 3) in view of the environmental situation on the river Oder, they have obtained operating income within the meaning of the tax rules in the month indicated in the Regulation at least lower by 50% in relation to revenue obtained in one of the two months preceding that month or in the corresponding month of the previous year; 4) by date 31 July 2022 reported at least one a person for retirement and pension insurance at the date of the establishment of pension and pension insurance not later than 1 July 2022 and at least one of the person remained in those insurances on the last day of the month indicated in the Regulation; by the date of 31 July 2022 reported to ZUS at least one the address of the activity in the municipality indicated in the Regulation.
The draft law also includes a draft regulation containing a list of PKD codes and a list of districts. The list of PKD codes may be updated during seismic work.
IMPORTANT: the payment of the benefit will only be made on request and the application itself can only be submitted electronically through the IT system of the Social Insurance Institution.
In the justification for the project we find that the number of persons entitled to receive the benefit is 68,446 .
Receipt of a one-off benefit shall be subject to income from less than or equal to 50% in relation to revenue obtained in one of the two months preceding the month indicated in the application or in the corresponding month of the previous year, the actual cost of payment of the benefit is expected to be lower than expected.
Financial data, in particular Information on the decrease in revenue of the authorised person is transmitted by the Social Security Office for verification by the Head of the National Tax Administration.
The submission of a false statement on the performance of an overriding business activity or a false statement on the decrease in revenue may entail criminal liability.
We hope that the draft bill in this version, or modified, will be quickly adopted by the Sejm and those in difficulty will receive material and organisational assistance.
